An Overview
Many Muslims stand confused on the differences of opinions they see on various matters in Islam. Why is there such a disagreement?! IsnÂ’t Islam from Allah TÂ’ala? DonÂ’t we Muslims have ONE QurÂ’an and One Sunnah? So, why is there such disagreement?!
This series of courses will take this topic from a practical perspective. Meaning, causes of disagreement and where it is acceptable and where it is not is a topic discussed in the Usool-ul-Fiqh realm. Studying such issues in this series of courses will be addressing issues of disagreement by studying the topics of Ijtihad themselves. So, we will be studying topics ranging from purification (Taharah), Prayer (Salah), Fasting (Siyaam), giving alms (Zakah), to Pilgrimage (Hajj). The study will present the Islamic evidences involved, analyze the honorable texts, and reflect on causes that might lead to differences in understanding. In addition, we will relate the various understandings of the Mathahib (schools of jurisprudence) to their respective principles of jurisprudence.
The approach to this material is not designed to convince one with one opinion over another, but rather to show why there is such a disagreement. Evidences and understandings will be presented to enable the Muslim student to adopt an opinion that convinces them most. Such adaption will be carried out based on knowledge of evidences, principles of jurisprudence, and disagreements. It will not, and should not, be done blindly.
Goals of this Series:
This study is designed to achieve various goals, some of which are: Deep knowledge of Islamic evidences related to area of Ibadaat.
1. Understand areas of disagreements amongst the four schools of Fiqh.
2. Determine causes of disagreements amongst jurists as found within the texts themselves as well as their adopted principles of jurisprudence.
3. Reflect on some of opinions reached and discuss points of weakness and strengths in the various arguments.
4. Learn to appreciate the depth of knowledge required for Ijtihad. Such knowledge should become a motivation to study Islam and its language in more depth.
5. Enhance the respect we must have to the various Islamic points of view.
6. Adopt an Islamic opinion based on knowledge of evidences.
Books and References:
This series of courses will utilize two books throughout:
1) Bidayat-ul-Mujtahid wa Nihayat-ul-Muqtasid by Ibn Rushd.
2) Fiqh-us-Sunnah by Sayyid Sabiq.
As both books are readily available in hard and soft copies, students will be required to have access to them. They will not be provided by An-Nahdah Institute. In addition, students will be asked to carryout their own research using other resources, such as, other Islamic books, articles, and the Internet.
For the positions of the various Schools of Thought (Mathahib) on the various issues, the instructor will rely mainly on the following books:
* Al-Mughni by Ibn Qudamah – Fiqh of Imam Ahmad bin Hanbal
* Al-Mabsoot by As-Sarkhasi – Fiqh of Imam Abu Haneefah
* Al-Mudawwanah Al-Kubra by Imam Malik - Fiqh of Imam Malik
* Al-Majmoo’ Sharh-ul-Muhathab by An-Nawawi – Fiqh of Imam Ash-Shaf’ie.
* Al-Fiqh on the Four Mathahib (Al-Fiqh ‘ala Al-Mathahib Al-‘Rba’ah) by Al-Juzairi.
